DCDRC asks Insurance provider to pay settlement to 2005 earthquake victims– Kashmir Reader

Srinagar: The District Customer Disputes Redressal Commission (DCDRC) Baramulla/Bandipora on Wednesday directed National Insurance provider Limited to pay Rs 6 lakh in favour of the 2005 earthquake victims for shortage of service and unjust trade practice, after 17 years.
The judgment mandates the business to pay an amount of Rs. 6 lakhs towards the plaintiffs in addition to an interest of 10% from the date of submitting the grievance within 4 weeks’ time.
The judgment likewise directed the insurance provider to pay Rs. 50 thousand towards the plaintiff for triggering psychological and physical harassment and lawsuits charges, a main spokesperson stated.
The judgment was given up reaction to a grievance lodged with the erstwhile State Customer Defense Commission Jammu on March 27, 2006, by the homeowners of Usman Nest, Khawaja Bagh, whose home sustained damage in the earthquake that happened on October 8, 2005 and was left uninhabitable.
The home in concern was guaranteed by National Insurance provider Limited for an amount of Rs.13 lakhs versus such scenarios however the business stopped working to satisfy its legal commitment to compensate the plaintiffs for the sustained losses.
The judgment gone by the bench administered by the President DCDRC Baramulla, Peerzada Qousar Hussain and other Member Judge, Nyla Yaseen discovered the insurance provider guilty of unjust trade practices under area 12 of customer Defense Act 1985, and for this reason directed them to compensate the complainant according to the set terms within 4 weeks time.
